Automatic Stay Bankruptcy Pennsylvania | Stop Creditors Immediately | Quinlan Law Group
The Automatic Stay — Immediate Relief from Creditors in Pennsylvania.
The automatic stay under 11 U.S.C. §362 is one of the most powerful tools in bankruptcy law. It takes effect the instant your bankruptcy petition is filed with the court — before any judge reviews your case, before any hearing is scheduled, before any creditor is notified. Every collection call, every lawsuit, every garnishment, every foreclosure proceeding stops immediately by operation of federal law.

What the automatic stay stops.
Under 11 U.S.C. §362(a), the automatic stay prohibits:
- All collection calls and written collection communications.
- All civil lawsuits against the debtor — including active trials.
- All garnishments and levies against property of the estate.
- All foreclosure proceedings — including scheduled sheriff's sales.
- All repossession of vehicles or other property.
- All utility shutoffs for 20 days after filing under 11 U.S.C. §366.
- All IRS collection actions — tax liens, levies, and seizures.
- All eviction proceedings (with some landlord exceptions).
Creditors who violate the stay after receiving notice are subject to sanctions, damages, and attorney's fees under 11 U.S.C. §362(k).
The automatic stay and Pennsylvania foreclosure.
Pennsylvania is a judicial foreclosure state — the foreclosure process runs through state court to sheriff's sale. The automatic stay stops the sale the moment the bankruptcy petition is filed, even hours before a scheduled sale. We have filed bankruptcy petitions the morning of a scheduled Pennsylvania sheriff's sale to stop it. If you have a sale date, call us immediately.
Limitations on the automatic stay.
The automatic stay does not stop:
- Criminal proceedings against the debtor.
- Child support and alimony collection.
- Certain tax proceedings.
- Evictions where judgment was entered before filing in most cases.
Serial filers: If you have had a prior bankruptcy case dismissed within the past year, the automatic stay may be limited to 30 days under 11 U.S.C. §362(c)(3) or may not apply at all under 11 U.S.C. §362(c)(4). We assess your filing history before every case.
