The 341 meeting of creditors — named for 11 U.S.C. §341 — is a required hearing in every bankruptcy case. It is held approximately 30-45 days after your petition is filed. Despite its name, creditors almost never appear. The meeting is conducted by the Chapter 7 or Chapter 13 trustee, not a bankruptcy judge, and typically lasts 5-10 minutes in a consumer case. What happens at the 341 meeting.

You appear before the bankruptcy trustee and answer questions about your bankruptcy petition under oath. The trustee verifies your identity, confirms the accuracy of your schedules, and asks standard questions about your assets, income, and recent financial transactions.

Standard trustee questions include:

• Did you sign the petition and schedules?
• Are all the information and schedules accurate and complete?
• Have you listed all your assets?
• Have you transferred any property in the past two years?
• Do you own any real estate?
• Are you expecting any inheritance, lawsuit proceeds, or tax refund?

The meeting is not adversarial. The trustee is verifying the record. With proper preparation, the 341 meeting is straightforward.
